KOIKE-YA Inc. and its group companies (hereinafter collectively referred to as "KOIKE-YA Group") provides information(“KOIKE-YA CCPA／CPRA Privacy Policy”) on the processing of personal information of our customers living in California, United States of America based on the California Consumer Privacy Act and California Privacy Rights Act (hereinafter collectively referred to as “CCPA／CPRA”).

KOIKE-YA Group will handle the said personal information in accordance with the "KOIKE-YA Privacy Policy" and this "KOIKE-YA CCPA／CPRA Privacy Policy". KOIKE-YA Group will also comply with the CCPA／CPRA even if it is not provided in the "KOIKE-YA Privacy Policy" or the "KOIKE-YA CCPA／CPRA Privacy Policy".

In the event that any provisions of this KOIKE-YA CCPA／CPRA Privacy Policy contradict those of KOIKE-YA Privacy Policy, the provisions of this CCPA／CPRA Privacy Policy shall prevail.

Definition.

Terms used in this KOIKE-YA CCPA／CPRA Privacy Policy are based on the definitions provided in CCPA／CPRA.

Acquisition and use of personal information

Personal information collected by KOIKE-YA Group in the past or likely to be collected in the future is classified as defined in the following table. KOIKE-YA Group uses such information for the purposes set forth in Article 4 (Purposes of processing personal information). It will acquire such personal information directly from customers.

(iii) Commercial information	Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies etc.
(iv) Internet or other electronic network activity information.	Information such as that on how customers use the KOIKE-YA Group website and mobile application, including details on cookies, advertising identifiers (IDFA/GAID), location information, unique device identifiers, details on OS and browser type, etc., and website activity logs

Purposes of processing personal information.

KOIKE-YA Group collect personal information in order to conduct the business, only for the following purposes. In addition, KOIKEYA Group may share or disclose personal data to third parties under confidentiality obligations only for the following purposes in order to conduct the business.

When required for authentication to use KOIKE-YA Group 's website;
When required to register for e-mail newsletter distribution services;
When required to apply for gifts, campaigns, etc., and to send prizes to winners;
When required for the purchase of products on the mail-order websites;
When required for product development and other service improvements and enhancements;
When required for inquiries to KOIKE-YA Group;
When required for the delivery of behaviorally targeted advertisements (To deliver advertisements that are linked to the content viewed by the customer based on the customer's browsing history, usage history, etc., of the website operated by KOIKE-YA Group) using an ad-serving company;
When required to analyze attribute information, behavioral history, etc. obtained by KOIKE-YA Group in order to understand the interests, preferences, etc. of customers;
When required for the use of KOIKE-YA Group 's website services;
When required for business-related communications, contract execution, business negotiations, etc.;
When required to exercise rights or fulfill obligations under laws;
When required to contact and provide information to applicants for employment or recruiting activities, or for other recruitment or recruiting activities
When required for business communication, payment of compensation (wages, bonuses, benefits, etc.), performance of personnel and labor management, provision of benefits, and health management for employees.

Request about handling of Personal Information

Customers living in California have the following rights concerning their personal information:

The right to know the purposes for which your personal information will be used.
The right to receive an explanation of the category of your personal information, the category from which your personal information is collected (from yourself), and the business or commercial purpose for collecting or sharing your personal information (selling snack foods).
A right to know personal information KOIKE-YA Group maintains about you and/or the categories of the third party with whom KOIKE-YA Group has shared the personal information or the categories of the third party to whom KOIKE-YA Group discloses the personal information.
A right to access the personal information, including obtaining the specific pieces of information collected from you.
A right to delete your personal information.

A right to opt-out of using personal information for targeting advertising or marketing purposes. Please note that if you have given your opt-out authorization, your right to request disclosure concerning your personal information is exempted if a third party who has your personal information uses it for direct marketing and the KOIKEYA Group knows or reasonably should know about it.
A right to non-discriminatory treatment for exercising any rights.
A right to initiate a private cause of action for data breaches.
A right to manage and request corrections to personal information.

To assert these rights, Customers may contact our appointed above inquiries at any time.
Customer may only make a verifiable customer request for access or data portability twice within a 12-month period. The verifiable customer request must:

Provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative.
Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity, or authority to make the request, and confirm the personal information relates to you. Making a verifiable customer request does not require you to create an account with us.

KOIKE-YA Group will only use personal information provided in a verifiable customer request to verify the requestor's identity or authority to make the request.

Deny

KOIKE-YA Group may deny your deletion request if retaining the information is necessary for us to:

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
Exercise free speech, ensure the right of another customer to exercise their free speech rights, or exercise other rights provided for by law.
Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
Enable solely internal uses that are reasonably aligned with customer expectations based on your relationship with us.
Comply with a legal obligation.
Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Debug products(including products used for KOIKE-YA Group business) to identify and repair errors that impair existing intended functionality.

Procedures for individual identification

For individuals
Upon receiving a request for the exercise of the Access Right or Deletion Right, KOIKE-YA Group will ask the customer to submit information sufficient to confirm that such request was submitted by such customer himself/herself, such as his/her name and email address, and compare the submitted information with the information held by KOIKE-YA Group.
For representatives
In addition to the information required for the identification of individual in “(ⅰ)For individuals,” a power of attorney (legal representatives must provide a certifying document) needs to be submitted. In addition, KOIKE-YA Group may ask the customer to directly contact KOIKE-YA Group to confirm that he/she has granted the representative authority to exercise the Access Right or Deletion Right.

Non-Discrimination

KOIKE-YA Group will not discriminate against you for exercising any of your CCPA／CPRA rights. Unless permitted by the CCPA／CPRA, we will not:

Deny you goods or services.
Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
Provide you a different level or quality of goods or services.
Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Others

At or before the time of collection of personal information, the KOIKE-YA Group will inform customers of the period of time it intends to retain personal information, or if that is not possible, the criteria used to determine that period. However, the KOIKE-YA Group will not retain personal information longer than the period which is reasonably necessary for the purposes for which it was collected, shared, or disclosed.
KOIKE-YA Group does not support Do Not Track(DNT) signal, etc. of browsers when customers use the KOIKE-YA Group website.
When customers use the KOIKE-YA Group website, third parties cannot obtain your personally identifiable information.

General provisions.

This KOIKE-YA CCPA／CPRA Privacy Policy was last revised on 01.01.2023. KOIKE-YA Group may change this KOIKE-YA CCPA／CPRA Privacy Policy from time to time in accordance with the law or in accordance with our policy. However, KOIKE-YA Group will not use the personal information of data subjects in new ways without their consent.
